Appliance Fires and Product Defects

Homeowners fires that start at a dishwasher, dryer, refrigerator or lithium-ion battery are among the largest missed recoveries a carrier carries, and they are lost at the scene. Once debris is hauled away, the product claim usually goes with it. Ishqkala reads the fire department narrative and adjuster notes for origin language, matches the model against CPSC recalls, and pushes scene holds before cleanup.

Average missed recovery

$42,000

Typical adverse parties

  • Appliance or device manufacturer
  • Component manufacturer (control board, battery cell)
  • Retailer or distributor in the chain of sale
  • Installer of a gas or electric appliance
  • Repair technician who last serviced the unit

Red-flag phrases

What the adjuster note says when there is a recovery.

  • FD says fire started at the dryer
  • origin at dishwasher per FD
  • insd heard pop from fridge, then smoke
  • e-bike was charging in garage
  • space heater running in bedroom
  • microwave came on by itself before
  • same model has a recall online
  • repair tech replaced control board in May

Loss scenarios

Who pays, and why.

Dishwasher fire with no one home

Manufacturer

Origin is traced to the control panel. Arc beads on the internal wiring harness point to a product failure rather than an external cause.

Lithium-ion battery thermal runaway

Battery or device maker, and seller

An e-bike or power tool battery ignites while charging. Cell remnants, the charger and purchase records identify the chain of distribution.

Dryer fire after a gas line connection

Installer

A recently installed gas dryer fails at the connection. The installer's work order and the connector are the key evidence.

Legal theories

The law behind the recovery.

Strict product liability
Manufacturing, design and warning defects support strict liability under Restatement (Second) of Torts § 402A or the Restatement (Third) approach, depending on the state.
Breach of implied warranty of merchantability
Under UCC § 2-314, a product that starts a fire in ordinary use was not merchantable. Privity and notice requirements vary.
Negligence
Installers and repair technicians are liable for faulty connections, wrong parts or ignored instructions.
Seller liability
Many states hold retailers strictly liable as part of the chain of distribution, while some innocent-seller statutes limit seller exposure when the manufacturer is solvent and reachable.

Evidence checklist

Preserve before you pursue.

  • Fire department incident report
  • Origin and cause report following NFPA 921
  • Investigator qualifications (NFPA 1033, IAAI-CFI)
  • Scene photos before any debris removal
  • Arc mapping documentation
  • Retained artifacts with chain of custody
  • Model and serial plate photos
  • Purchase, installation and service records
  • CPSC recall notices for the model
  • Notice letters to manufacturer, seller and installer

Recovery workflow

Step by step.

  1. 01

    Hold the scene

Real-Time FNOL Triggers flag appliance origin language so the adjuster can stop debris removal.

  2. 02

    Notify interested parties

Send scene-exam notices to every potential defendant before artifacts are moved.

  3. 03

    Run a joint scene exam

The origin and cause expert documents and collects artifacts under an agreed protocol.

  4. 04

    Lab exam and recall match

Examine artifacts and match model, serial and date codes against CPSC recalls.

  5. 05

    Score and route

Ishqkala scores the claim, tracks the SOL and product statute of repose, and routes it to product counsel.

Not for damage to the house and contents. It generally limits only claims for damage to the product itself.

Recovery gets harder and spoliation defenses get stronger. Photos and any retained artifacts may still support a claim, so Ishqkala scores these files rather than discarding them.

A recall is not proof of defect for this unit, and the recalled hazard must match the failure mode. When it does, it is strong evidence for the causation analysis and often speeds resolution with the manufacturer.
