Water Supply Line Failures
Supply line losses are frequent, expensive and usually paid without anyone asking who made or installed the part that failed. A cracked toilet coupling nut, a burst braided hose or a kinked ice maker line can support claims against a manufacturer or installer, but only if the part survives mitigation. Ishqkala flags supply line language at FNOL so the component is saved and the recovery has a chance.
Average missed recovery
$28,500
Typical adverse parties
- Supply line or fitting manufacturer
- Plumber or handyman who installed the line
- Retailer installation or delivery crew
- Appliance manufacturer
- Upstairs or adjacent unit owner
Red-flag phrases
What the adjuster note says when there is a recovery.
- plumber was out Tuesday to replace supply line
- braided line under kitchen sink burst
- toilet supply nut cracked
- new fridge delivered last month
- washer hose split, store installed it
- water heater replaced in March
- water coming from unit above
- insd kept the failed hose in garage
Loss scenarios
Who pays, and why.
Toilet supply coupling nut fracture
Manufacturer or installer
A plastic coupling nut cracks and floods two floors. Lab exam separates a material defect (manufacturer) from over-tightening (installer).
Ice maker line after appliance delivery
Delivery or installation crew
A refrigerator pushed back against a line kinks or pierces it. The delivery date in the diary note is the clue.
Water heater replacement leak
Plumbing contractor
A loose connection or missing drain pan on a newly installed heater causes a slow leak behind finished walls.
Failure in the unit above
Upstairs unit owner or association
Water from an upper condominium unit damages the insured's ceilings. The unit owner, its contractor or the association may owe the loss, depending on who maintained the failed line under the declaration.
Legal theories
The law behind the recovery.
- Strict product liability
- A manufacturing or design defect in a hose, nut or fitting supports a strict liability claim for damage to the home. The economic loss doctrine does not bar recovery for damage to other property.
- Breach of implied warranty of merchantability
- UCC § 2-314 implies the part was fit for ordinary use. Privity and notice rules vary by state.
- Negligent installation
- Installers who ignore manufacturer instructions, over-torque fittings or kink lines owe the resulting water damage.
Evidence checklist
Preserve before you pursue.
- The failed component, tagged with chain of custody
- Photos of the part in place before removal
- Packaging, brand, model and date codes
- Purchase receipt and installation invoice
- Plumber's report of the failure point
- Mitigation moisture maps and drying logs
- Xactimate estimate
- Notice letters to potential adverse parties
- Joint lab exam protocol and results
- CPSC recall check for the product
Recovery workflow
Step by step.
01
Save the part
Instruct mitigation and the insured to keep the failed component at FNOL.
02
Identify maker and installer
Ishqkala reads notes and invoices to name both and flags a recent install.
03
Put parties on notice
Send notice before any destructive testing so the exam is joint and spoliation defenses fail.
04
Test and score
A lab exam sets the theory. Ishqkala scores recovery against the SOL and any statute of repose.
05
Present the demand
Send lab findings, estimate and photos to the manufacturer or installer's liability carrier.
FAQ
Water Supply Line Failures FAQ
Usually weakened, rarely gone. Photos and the installer's invoice may still support a workmanship claim, but product claims depend on the part. Ishqkala FNOL triggers exist to stop that from happening on open files.
Destructive testing without notice invites a spoliation defense. ASTM E860 sets out a widely used practice for examining evidence that may become involved in litigation.
No. It scores the file and assembles the evidence. Your subrogation team or counsel makes the decision.
